How trademark law ranks brand names
A brand name is an asset, and the law values some kinds far more than others. Generic names, such as Cotton for a shirt, can never be protected. Descriptive names, such as Soft Tees, are refused on the USPTO's main register until they have earned recognition. Suggestive names hint at a quality without stating it, arbitrary names borrow an unrelated word the way Apple did for computers, and coined names like Kodak mean nothing until you make them mean something.
Those last three are protectable from your first sale, and they are also where the open .com names are, because descriptive phrases were registered long ago. Two unrelated words joined together, the pattern in the list on this page, usually land in the suggestive or arbitrary range.
Search the class your product sits in
Trademarks are registered by class of goods. Clothing is class 25, cosmetics and skincare class 3, jewelry class 14. Use the USPTO's free Trademark Search for your class and its neighbors, because examiners can treat different goods as related when shoppers would expect one company to sell both. Look for sound-alikes and spelling variants too, since Kwik and Quick count as the same word, and translations of your name can block it under the doctrine of foreign equivalents.
An application starts at $350 per class and usually takes more than a year. You can file on an intent-to-use basis before your first sale. You can use the TM symbol from day one, but the ® symbol is for registered marks only. Class 25 is among the most crowded, so keep two backup names ready in case your first choice fails.
Test it where the brand will appear
Mock the name on the smallest thing it has to fit: a woven neck label, a ring box lid, the side of a 30 ml bottle. Say it aloud to someone who has not seen it, and look it up in the languages of any market you plan to sell in.
Skincare needs one extra check: a name that promises to treat or heal can read as a drug claim to the FDA, so keep it to how the product looks or feels. If you plan to sell on Amazon, its Brand Registry needs a registered or pending trademark, with the brand name on the product or its packaging. Claim the matching Instagram and TikTok handles the day you register the domain, so the label, the site and the social accounts all say the same thing.
Brand name questions
Are these brand names available?
They were on October 30, 2026: domhaul checked 180 name ideas for clothing, skincare and jewelry brands against the registry and 125 had no registration. The 40 listed here all had an open .com. A name can be registered by someone else at any moment, so press Check again to rerun the list live before you buy.
How do I check if a brand name is trademarked?
Search the USPTO's free Trademark Search for the exact name, then for close spellings and sound-alikes, and filter to your class of goods. Check live and pending marks, not just registered ones. Then search Google and the marketplaces you plan to sell on, because unregistered brands can hold common-law rights in the places they already sell.
What is the difference between a brand name and a business name?
Your business name is the legal entity on your state filing, such as Northline Goods LLC. Your brand name is what appears on the product and what customers remember. One company can own several brands, and only the brand needs to be distinctive enough to trademark.
How much does it cost to trademark a brand name?
The USPTO's base application fee is $350 per class of goods, and most small brands start with one class. Extra fees apply if you write a custom description of your goods instead of picking from the USPTO's list. A trademark attorney is optional but worth pricing for a name you plan to spend real money behind.
How much does a brand domain cost?
A .com was $10.88 a year at the lowest standard price at Dynadot or Porkbun on October 24, 2026. domhaul's checkout adds a small service fee, and you see the exact total before you pay. Trademark filing is the bigger line in a brand budget, so clear the name first and buy the domain the same day.
